Statement - Michael Peyrebrune Subject: Contract between Mr M C Peyrebrune v Amateur Swimming Association

On the 21st December 1999, Mr Michael Peyrebrune was dismissed without notice following an Amateur Swimming Association (ASA) enquiry into expense claims.
Mr Peyrebrune successfully appealed against his dismissal.
In their decision, the appeals panel were of the unanimous opinion that summary dismissal was an inappropriate course of action. They were also of the opinion that although some of the claims were incorrect, none was made with the intent of financial gain.
Accordingly, the ASA admitted (for the purpose of Employment Tribunal proceedings) that Mr Peyrebrune’s dismissal was unfair and in breach of contract.
In the circumstances, Mr Michael Peyrebrune is looking forward to putting these matters behind him. He is currently attending to his PhD studies at Loughborough University and hopes to contribute fully to swimming and to sport in general in the future.
Mike Peyrebrune was given legal support and representation, through each stage of the disciplinary process by the BSCTA/GMB, and also through the complex negotiations which led to the ASA accepting that he had been unfairly dismissed.
